1. Introduction
These terms and conditions govern all web design, development, branding, and digital services provided by Bare Creative to clients. By commissioning work from Bare Creative, you agree to the following terms.
2. Definitions
- "We", "Us", "Our" refers to Bare Creative.
- "You", "Client" refers to the commissioning party.
- "Project" refers to the scope of work agreed between Bare Creative and the Client.
3. Quotation & Acceptance
All proposals or quotations are valid for 30 days. Acceptance may be made via email or signed approval. Work will not commence until the deposit is received.
4. Payment Terms
- A 50% non-refundable deposit is required to begin work.
- The remaining 50% is due upon project completion, prior to the website or final files being made live or delivered.
- Payments are due within 7 days of invoice. Late payments may delay delivery.
- All fees are exclusive of VAT unless otherwise stated.
5. Scope & Revisions
- The project scope is defined in the proposal. Any additional features, pages, or services outside the agreed scope will be quoted and charged separately.
- Includes up to 2 rounds of revisions for design, and 1 round for development.
- Additional revisions may incur extra charges.
6. Client Responsibilities
- You agree to provide all content, images, and feedback in a timely manner.
- Delays in providing assets or approvals may impact the timeline.
- You confirm that all materials provided (text, images, etc.) do not infringe on third-party copyrights or intellectual property.
7. Hosting & Domain
- Unless otherwise agreed, the Client is responsible for purchasing and maintaining hosting and domain services.
- We can assist with hosting setup and recommend providers.
- Bare Creative accepts no liability for downtime, data loss, or issues resulting from third-party hosting services.
8. Browser & Device Support
- Websites will be tested on the latest versions of Chrome, Safari, Firefox, and Microsoft Edge, and recent mobile devices.
- We do not guarantee full compatibility with obsolete browsers (e.g., Internet Explorer).
9. SEO & Performance
- We follow best practices for SEO and website performance.
- We do not guarantee specific search engine rankings.
10. Intellectual Property
- Final artwork and website code become the property of the Client upon full payment.
- We reserve the right to display the project in our portfolio and marketing materials.
- Third-party assets (fonts, images, plugins) may be licensed to the Client but remain owned by the original creators.
11. Cancellation & Termination
- If the Client cancels the project before completion, the deposit is non-refundable.
- Work completed up to that point will be billed proportionally.
- Bare Creative reserves the right to terminate a project due to non-payment, unreasonable demands, or lack of communication.
12. Support & Maintenance
- Support is not included unless specified in the project scope.
- We offer optional post-launch maintenance packages or support on a pay-as-you-go basis.
13. Liability
- Bare Creative is not liable for any loss, damage, or costs arising from use of the website or branding once delivered.
- We do not accept liability for security breaches unless part of a paid support agreement.
14. Confidentiality
We agree to keep all sensitive business information provided confidential and not share it with third parties without prior consent.
15. Governing Law
These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the English courts.
