These terms govern your use of this website and set out the general basis on which we provide our services. When we agree to a specific project, that work is also covered by a written proposal or statement of work. If anything in a signed proposal conflicts with these terms, the proposal takes precedence for that project.
BARE provides branding, website design and build, and ongoing marketing services. The exact scope, deliverables and timeline of any engagement are defined in the proposal we issue for that project. We do not guarantee any specific commercial outcome, ranking or result.
Quotes and proposals are valid for 30 days from the date of issue unless stated otherwise. A project is confirmed once you accept the proposal in writing and any required deposit has been received.
Project fees, payment schedules and any recurring charges are set out in the relevant proposal. Unless agreed otherwise:
To keep a project moving, you agree to provide timely feedback, approvals, content and access where needed, and to ensure that any materials you supply to us do not infringe the rights of others. Delays in providing these may affect the project timeline.
We work quickly and will share an indicative timeline in your proposal. Timelines depend on prompt feedback and approvals from you, and on the scope remaining stable. Significant changes to scope may affect both timeline and fees.
Each project includes a defined number of revision rounds, set out in the proposal. Once you approve a deliverable, further changes may be treated as additional work and quoted separately.
On full payment for a project, ownership of the final delivered work, including the brand assets and website, transfers to you. We retain ownership of any pre-existing tools, code libraries and processes we use to produce the work, and the right to display completed work in our portfolio unless you ask us in writing not to.
Ongoing marketing services run on a rolling monthly basis unless stated otherwise. Either party may cancel with 30 days' written notice. Content produced under a recurring service is owned by you once the relevant month's fee is paid.
If you cancel a project after it has started, you remain liable for work completed up to the cancellation date and for any non-recoverable third-party costs we have committed on your behalf.
We provide our services with reasonable skill and care. To the fullest extent permitted by law, our total liability arising from any project is limited to the fees paid for that project. We are not liable for indirect or consequential losses. Nothing in these terms limits liability for death, personal injury or fraud.
Each party agrees to keep the other's confidential information private and to use it only for the purpose of the project.
These terms are governed by the laws of England & Wales, and any disputes are subject to the exclusive jurisdiction of its courts.
